DCN INVITATION TO BID DATA COLLECTION AND PRIVACY POLICY<\/strong><\/h1>\n<\/div><\/div>
<\/div><\/div>

Dodge Construction Network (\u201cDCN,\u201d \u201cwe,\u201d or \u201cus\u201d) is pleased to offer its existing customers of DCN\u2019s subscription services (\u201cSubscription Services\u201d) the opportunity to participate in a free, newly developed feature called ITB Inbox. ITB Inbox will allow customers who choose to participate (\u201cProgram Participants\u201d or \u201cyou\u201d) the ability to: (a) have DCN collect and compile invitations to bid (\u201cITBs\u201d) from your business email account(s) through an automated process, and (b) access a DCN web portal that will allow \u00a0you to review, search, sort, download, and fill out your collected ITBs (collectively, \u201cApp Services\u201d). THERE IS NO CHARGE TO A PROGRAM PARTICIPANT FOR PARTICIPATING IN THE APP SERVICES, AND PROGRAM PARTICIPANTS ARE FREE TO OPT OUT AT ANY TIME. The App Services will be accessible through DCN\u2019s website alongside DCN\u2019s Subscription Services, and as an existing customer of DCN\u2019s Subscription Services, you may refer to DCN\u2019s general terms and conditions located at https:\/\/www.construction.com\/terms-of-use\/<\/a>, which remain applicable and in effect.<\/p>\n

This Privacy Policy explains (1) what data we collect from you; (2) how we collect, use, process, store, protect, and share your data, and (3) who we share your data with and under what circumstances. By selecting ACCEPT at the end of this Privacy Policy, you agree to these terms, as amended from time to time, and consent to the collection and use of information in the manner described here. A copy of this Privacy Policy can be always be accessed at https:\/\/www.construction.com\/privacy-policy-itb-inbox\/<\/a>. We encourage you to review this Privacy Policy periodically, including any subsequent changes made to it.<\/p>\n

WHAT DATA WE COLLECT FROM YOU<\/strong><\/p>\n

Personal Information and Connected Accounts<\/u><\/p>\n

Each Program Participant will be asked to allow DCN to access their Google, Yahoo, Microsoft, or other third-party business email account (\u201cConnected Account\u201d) for the limited purpose of collecting ITB data as described below. The Connected Account may provide us with personal identifying information (like your name, business email address, and profile picture).<\/p>\n

DCN\u2019s Process for Collecting Program Participant Emails containing Invitations to Bid<\/u><\/p>\n

We will connect to your Connected Account(s) using the log-in credentials provided by you and use an automated process to identify and download only those emails that contain or attach ITBs that were sent to you from general contractors.<\/p>\n

HOW WE USE THE COLLECTED DATA<\/strong><\/p>\n

ITBs, ITB Emails, and Program Participant ITB Portal<\/u><\/p>\n

As part of the App Services, each Program Participant\u2019s emails containing ITBs (\u201cITB Emails\u201d) will be collected from the Program Participant\u2019s specific Connected Account(s), and the ITBs will be separated and uploaded into your individualized portal (\u201cProgram Participant ITB Inbox\u201d), all through automated processes. \u00a0Each Program Participant, through their individualized Program Participant ITB Inbox, will be able to review, search, sort, download, and respond to the ITBs that were collected from their specific Connected Account(s). Program Participants will not be able to view ITBs collected from other Program Participants through the Program Participant ITB Inbox, however, Program Participants, as customers of DCN\u2019s Subscription Service, will continue to have access to DCN\u2019s general ITB database (\u201cOneTeam Database\u201d) through the OneTeam Database Portal.<\/p>\n

All collected ITB Emails and ITBs will be stored on a secure server maintained by DCN. From time to time, we may need to review individual ITB Emails for the purpose of improving the ITB identification, collection, or sorting processes, however, we will notify you and obtain your prior consent before allowing a human to review specific ITB Emails. Otherwise, an ITB Email will only be reviewed by a human if it\u2019s necessary for security purposes (for example, investigating abuse); to comply with applicable laws; or for internal operations only after the data has been aggregated and anonymized (for example, reporting aggregate statistics in an internal dashboard).<\/p>\n

OneTeam Database and ITB Subscription Service<\/u><\/p>\n

For each collected ITB, which do not identify the recipient of the corresponding ITB Email, DCN will, through automated processes, collect the project name, project location, and contact information of the general contractor. DCN may contact the general contractor for the purpose of obtaining its consent to allow DCN to incorporate the general contractor\u2019s ITB into DCN\u2019s OneTeam Database. DCN will not reveal the identity of any Program Participant to any general contractor. DCN may tally and record for internal purposes, through automated processes, the total number of Program Participants that received a specific ITB, however, DCN will not allow a human to review any information linking any specific Program Participant to any specific general contractor, except, as necessary, in the context of ITB Emails described above.<\/p>\n

HOW WE SHARE COLLECTED DATA<\/strong><\/p>\n

Sharing of Anonymized and Aggregated ITBs through OneTeam Database <\/u><\/p>\n

With the consent of the corresponding general contractors, as described above, the collected ITBs will be incorporated into DCN\u2019s OneTeam Database to allow all customers of DCN\u2019s Subscription Service to access and utilize the ITBs through DCN\u2019s OneTeam Database Portal. The ITB Emails collected from Program Participants will not be shared.<\/p>\n

Vendors and Service Providers<\/u><\/p>\n

We may share information with third-party vendors and service providers to help us provide, improve, and protect our services. These third parties will access your information only to perform tasks on our behalf and in compliance with this Privacy Policy.<\/p>\n

Legal<\/u><\/p>\n

We may disclose your information to third parties if we determine that such disclosure is reasonably necessary to (a) comply with the law; (b) protect any person from death or serious bodily injury; (c) prevent fraud or abuse of DCN or our Program Participants and customers; or (d) protect DCN\u2019s legal rights.<\/p>\n

Change of Control<\/u><\/p>\n

If we are involved in a reorganization, merger, acquisition, or sale of our assets, your information may be transferred as part of that deal. We will notify you of any such deal and outline your choices in that event.<\/p>\n

Consent<\/u><\/p>\n

We may share information with your consent.<\/p>\n

Marketing and Advertising<\/u><\/p>\n

We do not use or share your information with any third parties for direct marketing or advertising purposes.<\/p>\n

LIMITED USE DISCLOSURE IN COMPLIANCE WITH GOOGLE POLICIES<\/strong><\/p>\n

As described above, the use and transfer of information received from Google APIs for the App Services will adhere to the Google API Services User Data Policy and the Additional Requirements for Restricted Scopes, including the Limited Use requirements.<\/p>\n

SECURITY<\/strong><\/p>\n

DCN employs a variety of security technologies and measures designed to protect information from unauthorized access, use, or disclosure. The measures we use are designed to provide a level of security appropriate to the risk of processing your personal information. However, please bear in mind that the Internet cannot be guaranteed to be 100% secure.<\/p>\n

DATA RETENTION<\/strong><\/p>\n

We retain personal information we collect from you where we have an ongoing legitimate business need to do so (for example, to provide you with a service you have requested or to comply with applicable legal, tax, or accounting requirements). When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.<\/p>\n

CHANGES TO THIS PRIVACY POLICY<\/strong><\/p>\n

This Privacy Policy may be modified from time to time, so please review it frequently. Changes to this Privacy Policy will be posted on our websites. If we materially change the ways in which we use or share personal information previously collected from you through our services, we will notify you through our services, by email, or other communication.<\/p>\n

YOUR CHOICES AND REPRESENTATIONS<\/strong><\/p>\n

Your use of our services, including the App Services, is entirely voluntary, and you may opt out at any time, including by selecting DECLINE at the end of this Privacy Policy or by contacting us at Construction.Privacy.Policy@construction.com. If you choose to use our services by selecting ACCEPT, you warrant and represent to us that: (a) you are authorized to access the Connected Account; (b) you are authorized to provide the information we request in connection with the App Services, including the log-in credentials for the Connected Account; (c) your provision of access to the Connected Account, and DCN\u2019s access, do not violate any contract or employer policies; and (d) any information you provide to us is true and accurate. By selecting ACCEPT, you also warrant and represent that you are not a direct competitor to DCN or agent of a direct competitor to DCN, who are not permitted to use the App Services.<\/p>\n
