Andrew Cuomo announced <a href=\"https:\/\/www.thecity.nyc\/2020\/03\/27\/cuomo-calls-off-non-essential-construction-statewide\/\">a virtual construction shutdown<\/a> last month, Department of Buildings data shows.<\/p>\n<p>Some 4,936 job sites are now allowed to be worked on, up from about 800 on April 3, according to the Buildings Department.<\/p>\n<p>Among them: hotels in Manhattan and Brooklyn, a new Queens Target, and, as the Columbia Spectator first reported, the future home of <a href=\"https:\/\/www.columbiaspectator.com\/city-news\/2020\/04\/21\/columbia-construction-workers-ordered-to-return-to-sites-as-covid-cases-peak-in-nyc\/\">Columbia University\u2019s business school<\/a>.<\/p>\n<p>The greenlighted projects also include renovation work on rental buildings under an exception for a <a href=\"https:\/\/www.nyc.gov\/assets\/buildings\/pdf\/essential_vs_non-essential.pdf\">\u201csole worker,\u201d<\/a> raising concerns for tenants.<\/p>\n<p><strong>\u2018A Joke\u2019<\/strong><\/p>\n<p>Under a <a href=\"https:\/\/esd.ny.gov\/guidance-executive-order-2026\">revision<\/a> of its <a href=\"https:\/\/web.archive.org\/web\/20200327171726\/https:\/\/esd.ny.gov\/guidance-executive-order-2026\">original shutdown guidance<\/a>, the state has expanded \u201cessential\u201d building work beyond primarily infrastructure projects, hospitals and affordable housing.<\/p>\n<p>As long as ground already has been broken, construction now can also proceed on any type of business that\u2019s allowed to continue in-person operations during the state\u2019s coronavirus-driven \u201cpause.\u201d<\/p>\n<p>That broader list includes hotels, restaurants, convenience stores, banks, appliance stores and storage facilities, among other businesses. Public and private school construction is also permitted.<\/p>\n<p>One worker on a Manhattan hotel project fumed, saying his bosses were treating the pandemic like \u201ca joke.\u201d<\/p>\n<p>\u201cTo make the hotel essential, they might as well open every job, because that hotel is far from essential,\u201d he said. \u201cThat hotel is deemed essential while we are deemed expendable.\u201d<\/p>\n<p>The city\u2019s rules for \u201cessential business\u201d construction appear somewhat narrower than the state\u2019s.<\/p>\n<p>Work on \u201cessential businesses\u201d can proceed only \u201cif it pertains to alterations of existing buildings and has been permitted by the department prior to April 15, 2020, <a href=\"https:\/\/www.nyc.gov\/assets\/buildings\/pdf\/covid-19_construction_faqs.pdf\">the city guidance says<\/a>.<\/p>\n<p>DOB notes that the vast majority of the 35,000 sites that were ordered shuttered in March are still closed. But some local residents say they\u2019ve been shocked to see work going forward on a wide-ranging set of long-term projects while the pandemic still claims hundreds of lives per day.<\/p>\n<p><strong>\u2018Exploiting Loopholes\u2019<\/strong><\/p>\n<p>The <a href=\"https:\/\/www.thecity.nyc\/2019\/06\/04\/city-board-okays-basement-space-for-new-target-in-queens\/\">far-from-complete Target site<\/a> in Elmhurst, also slated to contain a Starbucks and a Chipotle, will eventually house some type of \u201cambulatory diagnostic treatment or healthcare facilities\u201d above the 23,000-square-foot big box store, city filings show. So the Department of Buildings is allowing construction to continue.<\/p>\n<p>Patricia Chou, a member of the grassroots community group Queens Neighborhoods United, which has long opposed the development, said that while a medical office may be in the offing, the core of the planned facility is still a shopping center.<\/p>\n<p>\u201cOur primary concerns are that they are endangering workers at the site and exploiting loopholes to complete this project,\u201d she said.<\/p>\n<p><img decoding=\"async\" style=\"height: 588px;\" src=\"https:\/\/www.construction.com\/wp-content\/uploads\/2022\/11\/download-1.webp\" alt=\"Aerial view of a construction site with multiple cranes and foundations, showing a large development.\" \/><br \/>\nA rendering of the planned Target in ElmhurstCourtesy of Target<\/p>\n<p>The construction work takes up space on 82nd Street and Baxter Street, which are routes to the emergency department entrance of coronavirus-slammed Elmhurst Hospital, Chou noted.<\/p>\n<p><strong>Solo Acts<\/strong><\/p>\n<p>Renovations also go on at residential buildings, under the exception that allows one-person jobs.<\/p>\n<p>One resident at an Upper East Side rental building said his landlord\u2019s continued remodeling work on apartments puts his family and other tenants, many of them elderly, at risk for a less-than-pressing reason.<\/p>\n<p>\u201cUnless it\u2019s a hot water issue or a heating plumbing issue, this is not the time to have any extraneous people in the building,\u201d said the resident, who didn\u2019t want his name published for fear of retaliation by his landlord.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.construction.com\/wp-content\/uploads\/2022\/11\/6462818633316614829.png\" alt=\"Graph showing an economic or construction related trend over time, possibly with multiple lines.\" \/><br \/>\nMembers and sponsors make THE CITY possible.<\/p>\n<p>Delivery people may not enter the building\u2019s elevators, but construction workers do. Meanwhile, the building\u2019s doorman is currently \u201cfighting for his life\u201d on a ventilator, the tenant said.<\/p>\n<p>\u201cEvery time I take an elevator down to the basement and I run across a construction worker, that\u2019s a potential interaction that I do not need to be having,\u201d he said.<\/p>\n<p>Want to republish this story?
