Andrew Cuomo has halted most construction statewide in response to the novel coronavirus pandemic sweeping New York, following outcry from workers and lawmakers when the industry was largely unaffected by <a href=\"https:\/\/ny.curbed.com\/2020\/3\/20\/21187022\/coronavirus-new-york-shutdown-shelter-in-place\">a shut down of all nonessential businesses<\/a>.<\/p>\n<p>Under the new directive, most residential and commercial construction is suspended, the governor announced Friday. Some crucial work, including on infrastructure, hospitals, and affordable housing, along with emergency repairs, will be permitted.<\/p>\n<p>\u201cWe\u2019re closing down nonessential construction sites,\u201d Cuomo said at a Friday press conference. \u201cSome construction is essential to keep the place running, but nonessential construction is going to stop.\u201d<\/p>\n<p>Initially, all construction in the state was classified as \u201c<a href=\"https:\/\/esd.ny.gov\/guidance-executive-order-2026\">essential<\/a>\u201d and exempt from the state\u2019s PAUSE order, which mandates all nonessential workers stay home. <a href=\"https:\/\/esd.ny.gov\/guidance-executive-order-2026\">In updated guidance<\/a>, the state declared that \u201call nonessential construction must shut down except emergency construction.\u201d Those who violate the new rule could face fines up to $10,000, according to city and state officials.<\/p>\n<p>In certain emergency circumstances, nonessential construction may move forward, such as to continue a project if it would be unsafe to allow it to remain unfinished.<\/p>\n<p>The order puts the kibosh on entirely luxury residential and office construction, but still permits work on apartment buildings with a majority of market rate units. <a href=\"https:\/\/www.nyc.gov\/assets\/buildings\/pdf\/essential_vs_non-essential.pdf\">Guidance on the updated mandate<\/a> by the city\u2019s Department of Buildings notes that construction is allowed on buildings where no less than 30 percent of the apartments are below-market rate or on projects that include <a href=\"https:\/\/council.nyc.gov\/land-use\/plans\/mih-zqa\/mih\/\">Mandatory Inclusionary Housing<\/a>\u2014a zoning mechanism that mandates either 25 or 30 percent of a building\u2019s units be set aside as below market rate.<\/p>\n<p>\u201cAnything that is not directly part of the essential work of fighting coronavirus and the essential work of keeping the city running and the state running, and any construction that is not about the public good, is going to end,\u201d Mayor Bill de Blasio said Friday on WNYC\u2019s The Brian Lehrer Show. \u201cSo luxury condos will not be built until this is over, office buildings are not going to be built.\u201d<\/p>\n<p>Cuomo\u2019s shift follows reports that construction had continued on sites where workers <a href=\"https:\/\/www.thecity.nyc\/nyc-construction-workers-on-job-amid-coronavirus-concerns\">tested positive for COVID-19<\/a>. Some sites, including <a href=\"https:\/\/go.redirectingat.com\/?id=66960X1516509&amp;xs=1&amp;url=https%3A%2F%2Ftherealdeal.com%2F2020%2F03%2F22%2Fmayor-questions-allowing-condo-construction-during-pandemic%2F&amp;referrer=archive.curbed.com&amp;sref=https%3A%2F%2Fny.curbed.com%2F2020%2F3%2F27%2F21196867%2Fcoronavirus-new-york-construction-andrew-cuomo-covid-19\">LaGuardia Airport and the Moynihan Train Hall<\/a>, temporarily stalled work due to sick workers.<\/p>\n<p>As the number of confirmed COVID-19 cases ballooned statewide, lawmakers criticized the governor and the mayor for allowing work on high-end apartments and office space to endanger the health of workers and their families.<\/p>\n<p>City Council members Carlos Menchaca and Brad Lander, along with Public Advocate Jumaane Williams, <a href=\"https:\/\/ny.curbed.com\/2020\/3\/20\/21188025\/coronavirus-covid-19-new-york-construction-moratorium\">pushed for the suspension of non-essential construction<\/a> and were pleased to see the state amended its guidance on non-essential building.<\/p>\n<p>\u201cThis is the right call,\u201d Menchaca said in a statement. \u201cI\u2019m glad the Governor finally heard the voices of construction workers who refused to stay silent while their health was being sacrificed for profits.\u201d<\/p>\n<p>Earlier this month Carlo Scissura, the president of the New York Building Congress, called a construction moratorium a \u201c<a href=\"https:\/\/ny.curbed.com\/2020\/3\/20\/21188025\/coronavirus-covid-19-new-york-construction-moratorium\">very dangerous proposition<\/a>,\u201d but in a Friday interview he said the updated guidance \u201cis a good policy\u201d that still allows for a host of crucial city projects to move forward.<\/p>\n<p>\u201cI think what we\u2019ve said from day one is that the health and safety of workers is paramount,\u201d says Scissura. \u201cI think this is a good policy, and hopefully, we\u2019ll just be shut down for a few weeks.\u201d<\/p>\n<p>James Whelan, the president of the Real Estate Board of New York, echoed those comments. \u201cWe agree that the health and safety of New Yorkers remains the top priority,\u201d he said in a statement. \u201cThese are challenging times and REBNY will continue to support all efforts to address the City\u2019s needs for public health and future economic growth.\u201d<\/p>\n<\/div><\/div><\/div><\/div><\/div><\/div><\/div><\/section>\n","protected":false},"excerpt":{"rendered":"New York bans nonessential construction amid coronavirus pandemic Work on infrastructure, hospitals, and affordable housing is still allowed A high-rise construction site in midtown Manhattan.
